These Terms and Conditions (“Terms”) govern your access to and use of the website and services provided by Fynd Professionals (“we,” “us,” or “our”). By registering with or using the Platform in any manner, you agree to be bound by these Terms in full. If you do not agree with any provision of these Terms, you are advised not to use the Platform.

1. Overview of the Platform

Fynd Professionals serves as a digital marketplace facilitating the connection between independent freelancers, small business owners, and prospective clients. We act solely as an intermediary platform and do not become a party to any contract entered into between users of the Platform.

2. User Eligibility

By using this Platform, you affirm that you are at least 18 years of age or the age of majority in your jurisdiction. You must have the legal capacity to enter into binding agreements and agree to comply with all applicable laws, statutes, and regulations.

3. User Accounts and Responsibilities

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to maintain the security and confidentiality of your credentials. You are solely responsible for all activities that occur under your account.

You agree not to:

  • Create an account using false information;
  • Impersonate another individual or entity;
  • Allow third parties to access your account.

4. Responsibilities of Service Providers (Freelancers and Business Owners)

Service providers agree to:

  • Provide clear, accurate, and up-to-date descriptions of services;
  • Deliver services in accordance with the terms agreed upon with clients;
  • Comply with all applicable laws and professional regulations, including tax obligations.

We reserve the right to suspend or terminate any profile that engages in fraudulent, misleading, or unethical behavior.

5. Responsibilities of Clients

Clients are responsible for:

  • Clearly communicating expectations, timelines, and deliverables;
  • Making timely payments for agreed services;
  • Resolving disputes directly with the service provider, where appropriate.

6. Payment Processing and Fees

Fynd Professionals may facilitate payment transactions through integrated third-party payment gateways. Any fees, taxes, or service charges will be outlined at the time of transaction. We are not liable for payment failures, disputes, or chargebacks initiated through third-party processors.

7. Dispute Resolution

While we may offer optional mediation services in the event of a dispute, we are under no obligation to become involved in disputes between users. All agreements, transactions, and communications between users are conducted at their own risk and discretion.

8. Prohibited Conduct

You agree not to use the Platform for:

  • Any unlawful or fraudulent activity;
  • Posting or transmitting harmful, defamatory, obscene, or otherwise objectionable material;
  • Spamming, phishing, or spreading malicious software.

We reserve the right to suspend or terminate access to any user who engages in prohibited conduct, without notice or liability.

9. Intellectual Property

All content on the Platform, including text, graphics, logos, software, and user interface design, is the property of Fynd Professionals or its licensors. Unauthorized reproduction or distribution of such content is strictly prohibited.

Users retain ownership of content they submit but grant Fynd Professionals a non-exclusive, royalty-free license to use, display, and promote said content on the Platform.

10. Limitation of Liability

Under no circumstances shall Fynd Professionals, its directors, officers, employees, or affiliates be held liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Platform.

11. Amendments

We reserve the right to modify, revise, or update these Terms at our sole discretion. Any such changes shall become effective upon being posted on the Platform. Continued use constitutes acceptance of the revised Terms.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in dispute arising area.

13. Buyer and Seller Relationship

All transactions are between the buyer (client) and the seller (freelancer or business owner).
Fynd Professionals acts only as a technology platform to facilitate discovery, communication, and connection. We are not a party to any service agreement, contract, or transaction made between users of the Platform.

Accordingly:

  • We do not guarantee the quality, accuracy, safety, or legality of services offered.
  • We are not liable for any disputes, delays, damages, refunds, or outcomes resulting from any engagement or transaction between users.
  • Users are solely responsible for verifying each other’s credentials and negotiating the terms of any engagement.

All risks arising from interactions or contracts between users are borne exclusively by the parties involved.
